These Terms & Conditions govern your purchase and use of Race to Immortal Beauty (the “Game”), which consists of an interactive digital dungeon master application, downloadable printable board maps, artwork, and a rulebook. The Game is sold and operated by Michael Patrick Fitzhugh (“we”, “us”, “the seller”). By purchasing or using the Game you are entering into an agreement with Michael Patrick Fitzhugh.
1. Acceptance of these terms
By creating an account, completing a purchase, or continuing to use the Game, you agree to these terms. If you do not agree, do not use the Game. You confirm that you are of legal age to enter into this agreement in your country, or that you have permission from a parent or guardian, and that where you are buying on behalf of an organisation you have authority to bind it.
2. What you receive
A one-time purchase grants you a limited, non-exclusive, non-transferable, personal licence to use the Game for your own tabletop play, including household and friends playing at your table. You may print the board maps for your own personal use. The licence does not include resale, redistribution, commercial exhibition for a fee, sub-licensing, or bundling the Game with any other product.
3. Account and accuracy
Access is tied to the account you create at checkout. You are responsible for keeping your password confidential and for all activity under your account. Please provide accurate information and keep it up to date so we can reach you about your purchase.
4. Acceptable use
You must not:
- use the Game for any unlawful purpose;
- commit fraud, send spam, or impersonate others through the Game;
- infringe our intellectual property or that of any third party;
- interfere with the security or integrity of the Game, including introducing malware, probing or scanning our systems, scraping content, or circumventing the purchase check or any other technical limit;
- reverse engineer, decompile, copy, resell, or redistribute the Game or its assets.
5. Artwork, story, and intellectual property
All rights in the Game remain with Michael Patrick Fitzhugh, including the software, the narrative and setting, the character of Christina, the creature and character artwork, the maps, the voice performance, the rulebook, and all branding. Nothing in these terms transfers ownership to you. If you believe material in the Game infringes your rights, contact us at mikefitz56+rtib@gmail.com and we will review and, where appropriate, remove or replace the material. We may suspend accounts that repeatedly submit infringing material.
6. Generated narration and content
The dungeon master narrates using synthesised speech and procedurally assembled text. This output is fiction produced for entertainment. It may be inaccurate, repetitive, or unexpected, and it is not advice of any kind. We may moderate, filter, or remove content served through the Game. You are responsible for anything you type into the Game and for having the right to use any content you supply, including any photograph you upload for an avatar.
7. Service level
We work to keep the Game available, but we do not guarantee uninterrupted or error-free operation. The Game may be unavailable for maintenance, updates, or reasons outside our control. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Payment, tax, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, and cancellation mechanics are governed by Paddle’s Buyer Terms. Refunds are covered by our Refund Policy.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, if payment is reversed or fails, if there is a security or fraud risk, or if you repeatedly or seriously violate the acceptable-use rules above. Where a purchase is refunded, access to the Game ends. On termination you must stop using the Game; you may keep board maps you have already printed for personal use.
10. Liability
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Game is limited to the amount you paid for it in the twelve months before the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.
11. Indemnity
You agree to indemnify us against claims arising from your unlawful use of the Game, from content you supply, or from your breach of these terms.
12. Changes
We may update these terms to reflect changes to the Game or the law. Material changes will be reflected in the “last updated” date above. Continued use after a change means you accept the updated terms.
13. Governing law and disputes
These terms are governed by the laws of the United States and the state of residence of Michael Patrick Fitzhugh, and the courts there have exclusive jurisdiction, without affecting any mandatory consumer rights in your own country. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond reasonable control.
